Village of Marcellus Council Proceedings Regular Meeting January 11, 2021

President Welburn called the regular meeting of the Marcellus Village Council to order at 7:00 p.m. on January 11, 2022. Trustees present: Simmons, Irwin, Thomas, Wilcox, Oswalt and Webb. 

Agenda

Motion by Simmons, seconded by Oswalt, to approve the agenda with the following addition: 

1. Under President’s Report – Add Item C. Appointment to MAESA Board 

Ayes: All. Nays: None. Motion carried. 

Minutes

Motion by Webb, supported by Welburn, to approve and place on file the minutes of the December 28, 2021, Regular Meeting. Ayes: All. Nays: None. Motion carried. 

Bills

Motion by Simmons, supported by Irwin, to authorize the payment of bills in the amount of $86,741.99. Roll call vote – Ayes: Irwin, Thomas, Welburn, Wilcox, Oswalt, Webb, and Simmons. Nays: None. Motion carried.

Frank Renaldi – DWSRF Water Project Update and Discussion Re: Sidewalks, Storm Water and Treatment Plant

Frank Renaldi, of Wightman & Associates, Inc., addressed the Village Council and meeting attendees with an update to the DWSRF Water Project, discussing the preliminary water project plan and the necessary vs. non-participating sidewalk repairs and costs, especially on Main Street, along with potential storm line repairs as part of the DWSRF project due to water lines and storm lines intersecting. The plan will be worked on and brought back to the Village Council for approval. 

Consent Agenda

Motion by Webb, supported by Oswalt, to receive and place on file all items on the Consent Agenda. Ayes: All. Nays: None. Motion carried.

President’s Report

Results of Stepheson Land Survey at 159 and 161 East Main Street, Marcellus and Offer to Purchase 159 East Main Street

Motion by Webb, supported by Welburn, to received and place on file the land survey conducted by Stepheson Land Surveying of Cassopolis, Michigan, for the properties at 159 and 161 East Main Street. Ayes: All. Nays: None. Motion carried.

Council members then discussed the offer to purchase the property at 159 East Main Street. 

Motion by Wilcox, supported by Oswalt, to decline the offer to sell the lot. Roll call vote – Ayes: Thomas, Welburn, Wilcox, Oswalt, Webb, Simmons and Irwin. Nays: None. Motion carried.

Appointment to MAESA Board

President Welburn appointed Christie VanTilburg to the MAESA Board with a term expiring on January 11, 2025. Motion by Irwin, supported by Oswalt to ratify and confirm that appointment. Ayes: Welburn, Wilcox, Oswalt, Webb, Simmons, Irwin and Thomas. Nays: None. Motion carried.

Clerk’s Report

November 23, 2021, Village Council Meeting Minutes Re: Resolution 2021-12 Effective Date

Clerk Terrill shared that the meeting minutes for November 23, 2021, reflect an incorrect effective date for Resolution 2021-12. The resolution correctly states its effective date is January 1, 2022, but the minutes incorrectly state January 1, 2021. Motion by Webb, supported by Oswalt, to correct the November 23, 2021, Village Council meeting minutes to reflect the correct effective date of January 1, 2022, for Resolution 2021-12. Ayes: All. Nays: None. Motion carried.

Baker Tilly Engagement Letter/Agreement for 2022 DWSRF Bonds

Motion by Webb, supported by Welburn, to approve and authorize the execution of the Letter of Engagement/agreement between Baker Tilly Municipal Advisors, LLC and the Village of Marcellus for Baker Tilly’s services in preparation for financing the Village’s DWSRF project. These services include the following for a fee of $11,250.00 which is payable from the loan/bond proceeds after closing: 

Preparation for financing:

• Debt structuring

• Outline of bonding options

• Managing the timetable

Specific assistance with the financing process includes:

• Bond specifications for the Bond

Authorizing Resolution

• Preparation and filing of the EGLE

formatted User Charge System

• Part I application preparation

• Part II application guidance

• Municipal Finance Authority liaison

• Bond rating application

• Department of Treasury assistance

• Review and approval of the cash flow

generated by the Finance Authority

• Closing assistance

Roll call vote – Ayes: Wilcox, Oswalt, Webb, Simmons, Irwin, Thomas and Welburn. Nays: None. Motion carried.

Zoning Solutions LLC – 799 South Centre Street

Village Trustees discussed the fire damage to the home at 799 South Centre Street and the escrow check received by the Village on July 26, 2021, for fire insurance withholding per MCL 500.2845 which allows for securing, demolition, destruction, repair or otherwise making safe of fire-damaged structures if necessary. 

The 120-day days for action to be taken is up.

Motion by Webb, supported by Thomas, to authorize the Village and its agent to advertise for bids for the demolition/cleanup of the property at 799 South Centre Street. Roll call vote – Ayes: Oswalt, Webb, Simmons, Irwin, Thomas, Welburn and Wilcox. Nays: None. Motion carried.

Southwest Community Action Agency Low-Income Household Water Assistance Program

Motion by Wilcox, supported by Oswalt, to approve and authorize the execution of the agreement for the Village of Marcellus to participate in the Low-Income Household Water Assistance Program (LIHWAP) with the Michigan Department of Health and Human Services (MDHHS) through the Southwest Community Action Agency. Participation in the program means the water provider will receive direct payment assistance for water and wastewater arrearages. The maximum amount/household cap is $650.00 for fiscal year per household for customers who apply for the program through the SMCAA, which determines eligibility. In addition, the water provider cannot shut off water service to residential customers for a minimum of 90 days after customer receives water assistance through this program. Roll call vote – Ayes: Webb, Simmons, Irwin, Thomas, Welburn, Wilcox and Oswalt. Nays: None. Motion carried.

December 2021 DPW Report

Motion by Irwin, supported by Thomas, to receive and place on file the December 2021 DPW Report. Ayes: All. Nays: None. Motion carried.

Motion by Simmons, supported by Wilcox, to adjourn at 8:14 p.m. Ayes:  All. Nays:  None. Motion passed.
