Porter Township – Van Buren County – Regular Meeting, February 14, 2024

Supervisor Oxley called the meeting to order at 7:00 p.m.  Members present – Oxley, Bitely, Nesbitt, Packer, and Smith.  Also present – Attorney Moraitis and five guests. 

Motion by Bitely with support by Nesbitt to approve the minutes of the regular meeting on January 10, 2024. Voice vote – all yes. Motion passed.

Motion by Bitely with support by Packer to approve the Treasurer’s report subject to audit. Voice vote – all yes. Motion passed.

Motion by Packer with support by Nesbitt to approve the bills as presented. Roll call vote – all yes. Motion passed.

Motion by Bitely with support by Nesbitt to amend the Marijuana Ordinances to allow Provisioning Centers to be open Monday – Sunday 9 am – 9 pm, pending attorney review. Roll call vote – all yes. Motion passed.

Motion by Nesbitt with support by Bitely to amend the Marijuana Ordinances to allow Provisioning Centers to have drive-up and curbside sales, pending attorney review. Roll call vote – Oxley, Nesbitt, Bitely, and Packer – yes, Smith – no. Motion passed.

Motion by Nesbitt with support by Bitely for Supervisor Oxley to sign the Agreement for Provision of Broadband Services with Midwest Energy & Communications, including the changes made by Attorney Moraitis and approved by Terry Rubenthaler from Midwest Energy & Communications. Roll call vote – all yes. Motion passed.

Motion by Nesbitt with support by Packer to adopt the 2024 Resolution to Set an Alternate Date for the March Board of Review First Taxpayer Appeal Meeting. Dates of March Board of Review will be Tuesday, March 12, 2024 and Saturday, March 16, 2024. Voice vote – all yes. Motion passed.

Motion by Nesbitt with support by Packer to adopt the 2024 Poverty Exemption Policy and Guidelines and Asset Test. Voice vote – all yes. Motion passed.

Motion by Nesbitt with support by Bitely to approve Supervisor Oxley’s recommendation to reappoint Robert Angle and Jeff Stull to the Planning Commission for 3-year terms. Voice call vote – all yes. Motion passed.

Motion by Bitely with support by Packer to remove retired Township Clerk Charles Meade, Jr from all Porter Township bank accounts at GW Jones Bank. Remaining signers on all Porter Township accounts at GW Jones Bank will be Treasurer Andrew Nesbitt and Clerk Heather Smith. Voice vote – all yes. Motion passed.

Motion by Bitely with support by Nesbitt to approve the hiring of Top Tier Customs to do blight cleanup of 7 properties, and add costs to property owner 2024 Winter tax bills, at a cost not to exceed $9,640. Roll call vote – all yes. Motion passed.

Motion by Packer with support by Nesbitt to purchase 4 ‘Welcome to Porter Township’ signs from the Van Buren County Road Commission, at a cost not to exceed $1,600. Roll call vote – all yes. Motion passed.

Motion by Packer with support by Bitely to hire Data Guardian to scan and digitize minutes from the 1960’s – 1980’s, at a cost not to exceed $700.  Roll call vote – all yes. Motion passed.

Motion by Packer with support by Nesbitt to adjourn the meeting at 7:55 pm. Voice vote – all yes.  

Motion passed.
