Village of Marcellus Council Proceedings

Regular Meeting – August 9, 2022

President Welburn called the regular meeting of the Marcellus Village Council to order at 7:00 p.m. on August 09, 2022, at the Marcellus Village Hall Council Room. Trustees present: Simmons, Irwin, Thomas, Haley and Webb. Trustee Oswalt was absent.

Agenda

Motion by Simmons, supported by Thomas, to approve the agenda as presented. Ayes: All. Nays: None. Motion carried. 

Minutes

Motion by Simmons, supported by Thomas, to approve and place on file the minutes of the July 26, 2022, Regular Meeting. Ayes: All. Nays: None. Motion carried. 

Bills

Motion by Simmons, supported by Irwin, to authorize the payment of bills in the amount of $161,350.94. Roll call vote – Ayes: Welburn, Webb, Thomas, Irwin, Simmons and Haley. Nays: None. Motion carried.

Frank Renaldi – DWSRF

Frank Renaldi explained the requirements for updating the Village’s Plans for its Water Mains and LSLR Projects to get them to an affordable level and requested the Village Council approve up to $32,000 for redesign of parts of the project, resubmittal to MDOT and to EGLE. Irwin, moved, supported by Thomas, to authorize the expense not to exceed $32,000 to continue with the plans, permits and system model and resubmittal to MDOT and EGLE. Roll call vote – Ayes: Simmons, Welburn, Haley, Webb, Irwin and Thomas. Nays: None. Motion carried. 

Consent Agenda

Motion by Webb, supported by Thomas, to receive and place on file all items listen on the consent agenda and noting Ordinance Enforcement Officer Mike Haydon’s report regarding human occupancy at non-residential sites at 259 Arbor and 201 Worden Streets. Ayes: All. Nays: None. Motion carried.

President’s Report

Village Boundaries

Motion by Webb, supported by Thomas, to revise the boundary areas to be annexed into the Village which will not exclude the portion on the northwest side of M-40 to and the property at 13095 M-40, (former home of the Tilted Lily), property to include provision for agreement with Marcellus Township that is the Village annexes the owned by Sugar Leaf on Hemlock Lake Road into the Village, the Township will continue to collect the marijuana licensing and excise tax fees so long as the business is at this location, with a portion of those licensing fees to be used for two additional days of police coverage by the Cass County Sheriff’s Department. Roll call vote – Ayes: Haley, Irwin, Thomas, Webb, Simmons and Welburn. Nays: None. Motion carried.

Ordinance No. 242 ORV Ordinance

Motion by Welburn, supported by Irwin, to approve and adopt Ordinance No. 242 an ORV Ordinance…. Roll call vote – Ayes: Webb, Simmons, Irwin, Haley, Welburn and Thomas. Nays: None. Motion carried.

Clerk’s Report

Commercial Garbage Accounts and 10% Fuel Surcharge (43 Accounts)

Clerk Terrill noted the Village’s contract with Michiana Recycling and Disposal calls for a 10% fuel surcharge when the price of diesel fuel is over $5.00 per gallon. At this time, only the commercial account services have been surcharged. The surcharge will be noted on the commercial account bills in addition to being noted on the Village website and social media page.

DPW

July 2022 DPW Report

Motion by Irwin, supported by Thomas, to approve and place on file the July 2022 DPW Report. Ayes: All. Nays: None. Motion carried.

JC and Sons Updated Tree Quote

Motion by Irwin, supported by Thomas, to approve the revised quoted from JC and Sons for 2022 tree work for $5,175.00. Roll call vote – Ayes: Thomas, Simmons, Welburn, Webb, Haley and Irwin. Nays: None. Motion carried.

Crossing Guard and DPW Advertisements

Motion by Irwin, supported by Simmons, to advertise for the open Crossing Guard and DPW positions. Roll call vote – Ayes: Webb, Haley, Welburn, Thomas, Irwin and Simmons. Nays: None. Motion carried.

Clerk’s Report

Act 51 – Annual Certification of Employee Related Conditions

Public Act 152 Exemption

Motion by Webb, supported by Irwin, the Village of Marcellus continue to exempt itself and therefore its employees from PA of 152 of 2011 (Act 51 funding) for the calendar year 2022, as permitted by Section 4 of that Act, for the express purpose of preventing the shifting of part of the cost of employer-provided health insurance to its employees and direct and authorize the Marcellus Village Clerk and Street Administrator to sign, execute and file with the Michigan Department of Transportation (MDOT) the Act 51 Annual Certification of Employee-Related Conditions for 2022, and/or any other document required with MDOT/the State of Michigan. Roll call vote – Ayes: Simmons, Thomas, Irwin, Webb, Haley and Welburn. Nays: None. Motion carried.

Motion by Simmons, supported by Thomas, to adjourn at 7:45 p.m. Ayes:  All. Nays:  None. Motion passed.
