Village of Marcellus Council Proceedings – Regular Meeting – January 9, 2024

President Irwin called the regular meeting of the Marcellus Village Council to order at 7:00 p.m. on January 09, 2024, in the Marcellus Village Hall. Trustees present: Markle, Engstrom, Welburn, Haley, Webb and Thomas.

Agenda
Motion by Engstrom, supported by Markle, to approve the agenda with the following addition: 
• Under Clerk’s Report – Add Item D. CVTRS-CLRF Certification
Ayes: All. Nays: None. Motion carried.

Minutes
Motion by Webb, supported by Markle, to approve and place on file the minutes of the December 28, 2023, Regular Meeting as presented. Ayes: All. Nays: None. Motion carried. 

Bills
Motion by Engstrom, supported by Haley, to authorize the payment of bills in the amount of $41,218.66. Roll call vote – Ayes: Haley, Irwin, Engstrom, Thomas, Webb, Welburn and Markle. Nays: None. Motion carried.

Consent Agenda
Motion by Webb, supported by Markle, to receive and place on file all items on the Consent Agenda, and to receive, place on file and give final approval of the MAESA budgets for 2023 and 2024, as approved by the MAESA Board which has disclosed its beginning and ending final balances as required by the State of Michigan Department of Treasury. Roll call vote – Ayes: Thomas, Welburn, Markle, Webb, Irwin, Engstrom and Haley. Nays: None. Motion carried.

President’s Report
Zoning Solutions, LLC Resignation Email Received 12/29/2023
President Irwin shared Zoning Solutions, LLC, December 29, 2023, resignation email from Beth Middleton, with an effective date of December 29, 2023. Motion by Irwin, supported by Welburn, to accept the resignation of Zoning Solutions, LLC, as the Village’s Zoning Administrator, effective December 29, 2023. Roll call vote – Ayes: Welburn, Markle, Engstrom, Haley, Webb, Thomas and Irwin. Nays: None. Motion carried.

DDA Appointments
President Irwin appointed Erica Watts and Bradley Smith to the DDA Board. Webb moved, supported by Welburn, ratifying and confirming the appointments with an expiration date of November 20, 2027. Roll call vote – Ayes: Engstrom, Thomas, Haley, Irwin, Welburn, Webb and Markle. Nays: None. Motion carried.

Clerk’s Report
AEP Quote for Additional Street Light at South Side of Jones and Main Streets
Motion by Irwin, supported by Welburn, to accept the quoted price of 6.45 per lamp, per month, from AEP for the installation of a 7,000 lumen MV-LED light on the wooden pole at the south corner of Jones and Main Streets. Roll call vote – Ayes: Engstrom, Markle, Irwin, Welburn, Webb, Thomas and Haley. Nays: None. Motion carried.

Employee Sick Pay Balances
Motion by Irwin, supported by Webb, to give Council agreement to rollover balances over 45 days to the 457b plan, as outlined in the Village’s Personnel Policy Manual, for the two employees whose balance have exceeded 45 days. Roll call vote – Ayes: Irwin, Welburn, Haley, Markle, Thomas, Engstrom and Webb. Nays: None. Motion carried.

Special Meeting for Public Hearing February 6, 2024, at 7:00 p.m. for MSHDA CHILL Program
Motion by Markle, supported by Thomas, to schedule a Special Meeting for a Public Hearing on February 6, 2024, at 7:00 p.m. for the purpose of hearing from all people interested in the Village’s application for funding under the MSHDA CHILL program, and to post the notice/invitation in The Marcellus News. The Village proposed to request $468,000 in CDBG funds to fund homeowner rehabilitation of existing housing to preserve the affordable housing stock in the Village of Marcellus. All funds will be used for rehabilitation of existing homes, including administrative costs. The entire amount is intended to benefit low to moderate income residents and no resident will be displaced as a result of the proposed activities. Roll call vote – Ayes: Thomas, Haley, Markle, Welburn, Irwin, Webb and Engstrom. Nays: None. Motion carried.

CVTRS – CLFRF Certification
Motion by Irwin, supported by Thomas, to approve the certification to the Michigan Department of Treasury for the Village’s City, Village, and Township Revenue Sharing and County Revenue Sharing – 1% Coronavirus Local Fiscal Recovery Fund (CLFRF). As outlined in the certification, each city/village/township/county applying for CVTRS and County Revenue Sharing – 1% Coronavirus Local Fiscal Recovery Fund (CLFRF) payments must certify to the Michigan Department of Treasury that the local unit has “Fully Obligated:” or expended by December 31, 2023, or declined, the total amount of 2021 American Rescue Plan Act (ARPA) funds (Public Law 117-2) allocated to the local unit. The State of Michigan defines “Fully Obligated” as “An order placed for property or services; entering into contracts, subawards, and similar transaction that requirements; or appropriating the funds for specific purposed.” In addition, the State of Michigan notes this definition is only for CVTRS-CLFRF and CRS-CLFRF programs and warns that the U.S. Treasury definition of “Fully Obligated” used for ARPA purposes is different. Roll call vote – Ayes: Markle, Haley, Welburn, Irwin, Webb, Thomas and Engstrom. Nays: None. Motion carried.

DPW
Cummins Sales and Service and Bender Electric Quotes for Purchase of and Installation of Transfer Switch at Pumphouse
Motion by Irwin, supported by Thomas, to reschedule the discussion on the purchase of and installation of a new transfer switch for the pumphouse generator to the January 23, 2024, Village Council meeting so that the DPW Superintendent has time to talk with a Cummins Sales and Service representative about the possibility of and costs associated with a higher National Electrical Manufacturers Association (NEMA) rating for the cabinet housing. The quote provided included a NEMA 3 rating, and a NEMA 4 rated enclosure generally provides a higher level of protection than does a NEMA 3 enclosure. Ayes: All. Nays: None. Motion carried.

December 2023 DPW Report
Motion by Irwin, supported by Markle, to receive and place on file the December 2023, DPW Report. Ayes: All. Nays: None. Motion carried.

Motion by Markle, supported by Haley, to adjourn at 7:45 p.m. Ayes:  All. Nays:  None. Motion passed.
