Village of Marcellus Council Proceedings – Regular Meeting: June 14, 2022

President Welburn called the regular meeting of the Marcellus Village Council to order at 7:00 p.m. on June 14, 2022, at the Marcellus Village Hall Council Room. Trustees present: Simmons, Irwin, Thomas, Oswalt and Webb. 

Agenda

Motion by Oswalt, supported by Simmons, to approve the agenda as presented. Ayes: All. Nays: None. Motion carried. 

Minutes

Motion by Webb, supported by Irwin, to approve and place on file the minutes of the

May 24, 2022, Regular Meeting and May 25, 2022 Special Meeting. Ayes: All. Nays: None. Motion carried. 

Bills

Motion by Simmons, supported by Oswalt, to authorize the payment of bills in the amount of $71,216.33. Roll call vote – Ayes: Irwin, Thomas, Welburn, Oswalt, Webb and Simmons. Nays: None. Motion carried.

Mike Haydon – Ordinance Enforcement

Village Council members and Ordinance Enforcement Officer Mike Haydon discussed the ongoing blight problem at 201 Worden Street. The owner had previously been found guilty of civil contempt on April 18, 2022, for disobeying an injunctive order against a public nuisance and was ordered to pay a court costs, attorney fees and reimbursement. (The fees do not cover the amounts the Village has spent on its attempts to get the property owner to comply with clean up requests, attorney fees, blight enforcement wages and previous clean-up by the Village.) The owner has failed to comply with the additional order to correct within the 30-day period, which means the Village may enter the property, correct and place the expense on the property taxes. Irwin moved, supported by Thomas, to approve spending up to $1,500.00 for clean-up of the property. Roll call vote – Ayes: Thomas, Welburn, Oswalt, Webb, Simmons and Irwin. Nays: None. Motion carried.

Crossing Guard Retirement

President Welburn reported Village Crossing Guard Jean Gailhouse has retired effective, June 10, 2022. President Welburn and Village Council members expressed appreciation for and thanked her for her many years of service to the Village and its children and presented her with an award plaque for her years of service.

Consent Agenda

Motion by Webb, supported by Oswalt, to approve all items on the Consent Agenda and to accept with thanks for his service, Jerry Motter’s resignation from the Village Planning Commission. Ayes: All. Nays: None. Motion carried.

President’s Report

Village Boundaries

President Welburn reported he is attempting to make an appointment with Marcellus Township Supervisor in order to discuss the Village’s desire to annex properties into the Village and to hear his concerns. 

Open Village Council Seat

President Welburn reminded the Council and those in attendance that there is still an open Village Council position.

Planning Commission Position

President Welburn appointed Brian Wilmore to the Village’s Planning Commission to fill the position left open by Jerry Motter, with a term expiring on April 20, 2023. 

Motion by Webb, supported by Simmons, to ratify and confirm that appointment. Roll call vote – Ayes: Welburn, Oswalt, Webb, Simmons, Irwin and Thomas. Nays: None. Motion carried.

Clerk’s Report

2022 Amounts Posted to Taxes

Motion, by Irwin, supported by Oswalt, to approve the 2022 amounts posted to taxes amounts. Roll call vote – Ayes: Oswalt, Webb, Simmons, Irwin, Thomas and Welburn. Nays: None. Motion carried.

Steensma Quote – Generators at Village Hall and Water Tower

Motion by Irwin supported by Oswalt, to authorize the signing of the quotes/contracts for two years with two inspections per year at the Village Hall and two years with one inspection per year at the Water Tower, presented by Steensma for routine maintenance on the generators located at the Village Hall and the water tower for a deposit price of $756.98 (hall) and $395.98 (water tower). Roll call vote – Ayes: Webb, Simmons, Irwin, Thomas, Welburn and Oswalt. Nays: None. Motion carried.

Cass County GIS Department Beacon Interactive Mapping Training

Motion by Thomas, supported by Oswalt to approve the Village Clerk and Utility Clerk attendance at the June 27, 2022, training day program for Cass County’s new Beacon Interactive Mapping program from 1:00 to 2:00 p.m. in the Cass County Building in Cassopolis, Michigan, and authorizing the closing of the Village Hall from 12:30 p.m. to 2:30 p.m., if the Village Treasurer is unavailable to cover this time. Roll call vote – Ayes: Simmons, Irwin, Thomas, Welburn, Oswalt and Webb. Nays: None. Motion carried.

Flowers and Planter Boxes on Main Street.

President Welburn thanked Modern Woodman, for its donation of flowers for the planter boxes on Main Street, Crop Services International for its donation of compost and soil amendments for the planter boxes and the volunteers who provided the labor for plantings on Main Street.

Michigan Basic Property Insurance Renewal Rental Building No. 1

Clerk Terrill shared the notice of an insurance policy expiration and renewal offer from Michigan Basic Property Insurance Association for Building 1 of the Village’s rental property, which is occupied at 59% by Marcellus Metalcasters and 41% by Faith Plastics. The total premium due is $4,289.00. Thomas moved, supported by Welburn, to renew the policy and authorizing the payment included in the June 14, 2022, bills list. Roll call vote – Ayes: Irwin, Thomas, Welburn, Oswalt, Webb and Simmons. Nays: None. Motion carried. 

Clerk Terrill noted that the insurance renewal for Building 2, occupied 100% by Faith Plastics will happen in August.

DPW

May 2022 DPW Report

Motion by Irwin, supported by Simmons, to receive and place on file the May 2022 DPW Report. Ayes: All. Nays: None. Motion carried.

Personnel Committee

Health Coverage and Cash in Lieu of Coverage

Motion by Irwin, supported by Thomas, to authorize the payment of $40.00 per week for the recent DPW hiree who has elected to waive participation in the Village’s Health Insurance plan as has been the practice since January 1, 2017. Roll call vote – Ayes: Thomas, Welburn, Oswalt, Webb, Simmons and Irwin. Nays: None. Motion carried.

Open Crossing Guard Position

Motion by Irwin, supported by Oswalt, to advertise/post the open Crossing Guard position in mid-August. Roll call vote – Ayes: Welburn, Oswalt, Webb, Simmons, Irwin and Thomas. Nays: None. Motion carried.

T-shirts for Crossing Guards/Janitor

Motion by Irwin, supported by Thomas, to authorize the purchase of three t-shirts for the Village’s crossing guards/janitor at a total cost of $30.00. Roll call vote – Ayes: Oswalt, Webb, Simmons, Irwin, Thomas and Welburn. Nays: None. Motion carried.

Adjournment

Motion by Simmons, supported by Welburn, to adjourn at 8:11 p.m. Ayes:  All. Nays:  None. Motion passed.
