Village of Marcellus Council Proceedings Regular Meeting March 22, 2022

President Welburn called the regular meeting of the Marcellus Village Council to order at 7:00 p.m. on March 22, 2022. Trustees present: Simmons, Irwin, Thomas, Wilcox, and Webb. Trustee Oswalt was absent.

Agenda

Motion by Irwin, seconded by Welburn, to approve the agenda as presented. Ayes: All. Nays: None. Motion carried. 

Minutes

Motion by Webb, supported by Welburn, to approve and place on file the minutes of the March 08, 2022, Regular Meeting. Ayes: All. Nays: None. Motion carried. 

Bills

Motion by Simmons, supported by Irwin, to authorize the payment of bills in the amount of $90,648.09. Roll call vote – Ayes: Irwin, Thomas, Welburn, Wilcox, Webb and Simmons. Nays: None. Motion carried.

Brian Hake – Kruggel & Lawton 2021 Audit Report

Staff Accountant Brian Hake, of Kruggel & Lawton, provided the Village Council with a brief synopsis of the 2021 audit, highlighting the following, after informing the Council that although the standards and look of the of audit performance have changed, the substance of the report has not:

1. The Village’s General Fund balance increased by $113,000 bringing the fund up to a 12.5-month fund balance.

Mr. Hake reminded the Council that although the village has received half of the ARPA funds and is expected to receive the balance by May 2022, the ARPA funds will only be recognized as revenue when there is a qualifying expense.

2. Total governmental funds increased by $198,000.

3. The Village’s three proprietary funds increased in 2021 as follows: Sewer Fund $125,000, Water Fund $127,000 and Garbage Fund $4,000.

4. There were no budget overages in 2021.

5. The Village’s budgets are well thought out and the amendments are being   completed properly.

6. The Village’s deposits and investments continue to represent a custodial credit risk, that is, the risk that in the event of a bank failure, the Village’s deposits may not be returned to it. The Village maintains some cash balances using sweep accounts to invest idle cash in the U.S. Government backed securities. Non-sweep accounts at each institution are insured by the Federal Deposit Insurance Corporation (“FDIC”) up to $250,000. As of December 31, 2021, $1,809,158 of the Village’s bank deposit balance of $2,559,158 was exposed to custodial credit risk because it was in excess of FDIC coverage limits.

7. Brian Hake thanked the Village Clerk for her level of response and cooperation during the audit process. A lot of work goes into completing the audit and the work put into its completion by the Village Clerk is appreciated. There were fewer than half the number of audit adjustment entries this year due to the complexity of the bond refunding adjustments and the Clerk’s increased understanding and efforts to make the required entries as opposed to relying on the auditor, which leads to a more finished product for the audit team.

Motion by Webb, supported by Simmons, to receive and place on file the Kruggel & Lawton audit of the Village of Marcellus’s financial records for 2021. Roll call vote – Ayes: Thomas, Welburn, Wilcox, Webb, Simmons and Irwin. Nays: None. Motion carried. 

Consent Agenda

Motion by Webb, supported by Thomas, to receive and place on file all items on the Consent Agenda. Ayes: All. Nays: None. Motion carried.

President’s Report

Alisa Burleigh Resignation from DDA Board

Alisa Burleigh has resigned from the Village of Marcellus DDA Board, citing conflicts with her ability to attend the required meetings. 

Motion by Webb, supported by Simmons, to accept with thanks for her service, Alisa Burleigh’s resignation from the DDA. Ayes: All. Nays: None. Motion carried. 

Clerk’s Report

MDOT Updated Performance Resolution 

Clerk Terrill shared communication from Michigan Department of Transportation (MDOT), which requires the Village to update their Performance Resolution for Governmental Agencies. Motion by Webb, supported by Irwin, that the updated Performance Resolution for Governmental Agencies be approved, executed and filed with MDOT. Ayes: All. Nays: None. Motion carried.

Resolution 2022-02 – Resolution Decertifying a 160’ Section of Arbor Street Across M-40 and the Railroad in the Village of Marcellus

Motion by Irwin, supported by Thomas, to adopt Resolution 2022-02, a Resolution Decertifying a 160’ Section of Arbor Street Across M-40 and the Railroad in the Village of Marcellus. Roll call vote – Ayes: Welburn, Wilcox, Webb, Simmons, Irwin and Thomas. Nays: None. Motion carried.

Village-owned Property Public Utility Easement

Motion by Webb, supported by Wilcox, to approve and execute the public utility easement on the village-owned property at 239 East Main Street, Marcellus, Michigan, (Tax ID: 14-051-511-001-00) for a 3,917 square foot permanent easement on the property in conjunction with water main placement during the Marcellus DWSRF Water System Improvements Project, and to waive the associated fees, as revised. Roll call vote – Ayes: Wilcox, Webb, Simmons, Irwin, Thomas and Welburn. Nays: None. Motion carried

Motion by Webb, supported by Thomas, to approve the easement valuation and associated documents as revised. Roll call vote – Ayes: Webb, Simmons, Irwin, Thomas, Welburn and Wilcox. Nays: None. Motion carried.

Marcellus Community Schools and Village-owned Property

Clerk Terrill reported to the Council that the Marcellus Community Schools property and Village-owned property, which were annexed on March 11, 1986, have been assigned new Village of Marcellus Parcel ID numbers and will become active through the March 2023 Board of Review. The State of Michigan and Cass County previously recognized/acknowledged the annexation.

Storage Lease Agreement at Railroad Property– Grames Tire & Battery

Motion by Irwin, supported by Wilcox, to ratify and confirm the lease agreement for Building 4 between the Village of Marcellus and Grames Tire & Battery. Roll call vote – Ayes: Simmons, Irwin, Thomas, Welburn, Wilcox and Webb. Nays: None. Motion carried.

DPW

Tree Quotes 2022

Motion by Irwin, supported by Thomas, to approve the quote provided by JC & Sons, Inc., at $10,800.00 for tree removal and trimming in 2022. Roll call vote – Ayes: Irwin, Thomas, Welburn, Wilcox, Webb and Simmons. Nays: None. Motion carried.

Quote – Cement Pad – Bruce Ivens

Motion by Simmons, supported by Welburn, to approve the quote provided by Bruce Ivens, at $2,500.00 for cement work at Building 4 on the Railroad Street property, with the DPW doing prep work and Village purchasing cement for the project from Dave’s Concrete in Lawton, Michigan. Roll call vote – Ayes: Thomas, Welburn, Wilcox, Webb, Simmons and Irwin. Nays: None. Motion carried.

Personnel Committee

DPW Position

Motion by Irwin, supported by Simmons, to authorize the village clerk to advertise for the DPW position being vacated by Adam Brown by May 14, 2022. Roll call vote – Ayes: Thomas, Welburn, Wilcox, Webb, Simmons and Irwin. Nays: None. Motion carried.

Adjournment

Motion by Simmons, supported by Thomas, to adjourn at 8:35 p.m. Ayes:  All. Nays:  None. Motion passed.
