Village of Marcellus Council Proceedings – Regular Meeting, September 12, 2023

President Irwin called the joint meeting of the Marcellus Village Council and the Village of Marcellus Planning Commission to order at 7:00 p.m. on September 12, 2023, in the Hudson Memorial Building. Trustees present: Markle, Engstrom, Welburn, Thomas, Haley and Webb. 

Agenda
Motion by Oswalt, supported by Markle, to approve as presented. Ayes: All. Nays: None. Motion carried.

Minutes
Motion by Webb, supported by Engstrom, to approve and place on file the minutes of the August 22, 2023, Regular Meeting. Ayes: All. Nays: None. Motion carried. 

Bills
Motion by Engstrom, supported by Haley, to authorize the payment of bills in the amount of $617,4065.64. Roll call vote – Ayes: Welburn, Engstrom, Thomas, Haley, Irwin, Markle and Webb. Nays: None. Motion carried.

Public Comment
Request to use Village-owned Property for Group Event
Village Resident Tamey Scoggin addressed the Village Council and requested use of the “old football field” at 499 South Burney Street for a “Spirit Night” event for teens and their parents on September 27, 2023, from 4:00 p.m. to sunset or 7:30 p.m. After discussing supervision, emergency services and event/park reservation application requirements, Welburn moved, supported by Oswalt, to approve the use of the Village-owned property as requested. Roll call vote – Ayes: Irwin, Webb, Thomas, Engstrom, Markle, Welburn and Haley. Nays: None. Motion carried.

DDA Request for Council Support and Involvement
DDA Members Blake Terrill and Seth Carlson, along with DDA Economic Development Director Sarah Ayers reminded Village Council members that the DDA’s Oktoberfest is scheduled on September 30, 2023, from 3:00 p.m. to 9:00 p.m., and requested Village Council presence, assistance and involvement in the activities and fundraising events. The DDA is hosting the event to bring the community together in support of and fundraising for the stabilization of the former Tailgater building.

Planning Commission
Zoning Ordinance Review
Kyle Mucha of McKenna of Kalamazoo, Michigan, addressed the Village Council and shared two memoranda outlining the Planning Commission’s progress to update its current Zoning Ordinance. Planning Commission members, members of the Village Council and DDA members present, and the Village’s Zoning Administrator discussed the proposed changes and asked for comments and suggestions. The Planning Commission will continue its review during its next Planning Commission meeting with the intent to hold another joint meeting with the Village Council for a Zoning Ordinance Hearing on November 21, 2023.

Frank Renaldi – Updates Re: Water Project, High Water Project, Downtown Beautification and DWSRF 2024
Frank Renaldi of Wightman & Associates provided updates regarding the following projects:

Water Project:
– Added storm and Dibble Pond,
– Deleted storm at North and Centre,
– Add leaching basin north of Dibble and Maple,
– Have DPW pick up water service as-built information when water main or restoration are not being worked on,
– Invoice 4 sent for approval today,
– Meeting with Lance Thursday to review budget,
– Status of water leak at Woodland and Burney, and
– Next progress meeting tentatively Sept 26th, 3pm.

High Water Project:
– Kickoff meeting October 10th at 3:30,
– Bringing W+ site team and Laura for landscaping, and
– Village invited Faith and Metalcasters Representatives

Downtown Beautification:
– Plans updated and returned to MDOT,
– Will Bid asap after approved.

DWSRF 2024 
– not funded this year, no LSL replacements, and no PFAS
– talk to Lance at EGLE (will ask Thursday) and talk to Walberg’s office,
– set up meeting with Village staff to review options for short and long term, and
– does the Village reapply for 2025 funding.

Sanitary System Study:
– Will send proposal for sampling and analysis before next council meeting,
Analyzing existing system capacity,
Feasibility study for future (5yr and 20yr plans),
Review contract with and meeting with LASA to discuss their future plans, and
Need to include time for Nofsinger and Baker-Tilly in the Village project budget.

   After the updates were provided, Council members discussed assigning priority and affordability of non-participating items being added to the current water project.

Consent Agenda
Motion by Webb, supported by Engstrom, to receive and place on file all items on the Consent Agenda. Ayes: All. Nays: None. Motion carried.

Clerk’s Report
Ordinance No. 248 – Civil Infractions Ordinance
Motion by Irwin, supported by Welburn, to adopt Ordinance No. 248, An Ordinance Establishing the Authority for Certain Individual Ordinances of the Village to be Amended to Convert Criminal Penalties into Civil Penalties Pursuant to the Statute Made and Provided. The Ordinance shall take effect October 21, 2023. Roll call vote – Ayes: Thomas, Engstrom, Haley, Irwin, Welburn, Webb and Markle. Nays: None. Motion carried.

RAP Grant  – Downton Beautification Project Schedule

Clerk Terrill shared the tentative project implementation schedule for the Revitalization and Placemaking (RAP) Grant for the Village’s Downtown Beautification Project as follows:

State high Water Infrastructure Grant Agreement
Motion by Irwin, supported by Markle, to approve and authorize the execution of the State High Water Grant Program agreement between the Michigan Department of Environment, Great Lakes, and Energy and the Village of Marcellus. The agreement for funding of the Village’s 

“Mitigation of Lake Marcellus” project to address roadway flooding around one block of downtown Marcellus at a total estimated project cost of $534,940, to be funded with grant funds of $427,952 and match funds of $106,988. Roll call vote – Ayes: Haley, Markle, Webb, Irwin, Thomas, Engstrom and Welburn. Nay: None. Motion carried.

Personnel Committee
Crossing Guard Position – Marylin “Sue” Park
Motion by Engstrom, supported by Welburn to approving the hire of Marylin “Sue” Park on August 28, 2023 as a permanent part-time Crossing Guard at the rate of $16.00 per hour. The background check and drug tests were returned with favorable results. Roll call vote – Ayes: Welburn, Webb, Irwin, Engstrom, Thomas, Haley and Markle. Nays: None. Motion carried.

DPW Superintendent Timothy Weston Eight-Year Evaluation
Trustee Irwin reported DPW Superintendent Timothy Weston received a favorable eight-year evaluation and is eligible for a 50-cent per hour increase according to the Village’s resolution for scheduled wage increases. Engstrom moved, supported by Irwin, to approve the scheduled raise of .50 per hour effective on his employment anniversary date, September 8, 2023, and the recommended revision of the policy set by motion on December 11, 2018, that the DPW Superintended receive $1.00 per hour in lieu of the benefit of driving the Village-owned water truck to and from work by allowing the truck to be driven to and from work with no change in rate of pay.  Roll call vote – Ayes: Markle, Engstrom, Haley, Webb, Irwin, Welburn and Thomas. Nays: None. Motion carried.

Michael Clark and Landon Hackenberg Water Training
Motion by Irwin, supported by Markle, to approve attendance of and payment for Michael Clark and Landon Hackenberg to attend the one-day math training provided by the MRWA online via Zoom on October 30, 2023, and Michael Clark to attend the Limited Treatment (Lagoon D Certification) class online via Zoom on October 10-11, 2023, with the total cost for both training events of $525.00. Roll call vote – Ayes: Haley, Welburn, Markle, Engstrom, Irwin, Thomas and Webb. Nays: None.  Motion carried.

August 2023 DPW Report
Motion by Irwin, supported by Webb, to receive and place on file the August 2023 DPW Report. Ayes: All. Nays: None. Motion carried.

Motion by Markle, supported by Thomas, to adjourn at 8:39 p.m. Ayes:  All. Nays:  None. Motion passed.
