President Ronald Welburn called the special meeting of the Marcellus Village Council to order at 7:00p.m. on May 25, 2022, in the Marcellus Village Hall Fire Station after Planning Commission Chair James R. Thomas, Jr., called the Planning Commission Special Meeting to order. Trustees present: Irwin, Thomas, Oswalt, Webb and Simmons.
Planning Commission Chair James R. Thomas, Jr., immediately took the Planning Commission into Public Hearing(s). The only items on the Village Council agenda were the Special Planning Commission Meeting, Special Land Use Hearing for 166 S Burney, LLC (The Woods) and Site Plan Review for Grames Tire & Battery.
Village Council observed the following:
1. 166 S Burney, LLC (The Woods)
Planning Commission Chair, James R. Thomas, Jr., and Zoning Administrator Beth Middleton, of Zoning Solutions, LLC, addressed Zander Keiswetter of 166 S Burney LLC (The Woods) and reviewed the submitted Application for a Village of Marcellus Marihuana Operating License, the proposed business plan and security plan provided by the company, followed by discussion and question/answer period.
2. Grames Tire & Battery Site Plan Review
After a lengthy discussion and review of the hand-drawn preliminary sketch provided by Brian Lamoreaux and Grames Tire & Battery, Village Attorney Luke Nofsinger recommended the Planning Commission make a conditional approval for the Site Plan under the condition that professional drawings be submitted to the Planning Commission during its next Planning Commission meeting.
The Planning Commission closed its Public Hearing(s), returned to open session at 9:03 p.m., whereupon it approved the Special Use for 166 S Burney (The Woods) and gave conditional approval for the Site Plan at Grames Tire & Battery, including the requirement that zoning ordinance requirements be met, and proper drawings are submitted to the Planning Commission by August 24, 2022.
At 9:06 p.m., the Village Council took the following actions as part of the Village Council’s Open Meeting/Special Meeting.
Attend and Observe Special Meeting for 166 S Burney LLC and Grames Tire & Battery
Not barring other further formal action by the Marcellus Council, Trustee Webb moved, supported by Trustee Irwin, to adopt, approve, enact, ratify and confirm all actions taken, approved and adopted by the Village of Marcellus Planning Commission at its May 25, 2022, meeting concerning:
1. 166 S Burney, LLC (The Woods) property and approval of its proposed recreational marihuana establishment retail business, provisional certificate, and
2. Grames Tire & Battery and its site plan for a new building at 471 E Main Street, which the Planning Commission conditionally approved and required that zoning ordinance requirements be met.
Roll call vote – Ayes: Oswalt, Webb, Simmons, Irwin, Thomas and Welburn. Nays: None. Motion carried.

Motion by Simmons, supported by Oswalt, to adjourn at 9:13 p.m. Ayes: All. Nays: None. Motion carried.
