Village of Marcellus, County of Cass, State of Michigan – Ordinance Amending Section 3 of the Planning Commission Ordinance (No. 193)

An Ordinance AMENDING Section 3A. of the Planning Commission Ordinance (No. 193) to broaden/expand the Village boards and commissions to which Planning Commission members may be appointed and serve.

THE VILLAGE OF MARCELLUS ORDAINS:
Section 3A. is hereby amended to read as follows:

• Section 3 – Composition of Planning Commission, Number, Qualifications,  Appointment, Term, Compensation, Removal, Vacancies.

1. Composition, Number and Qualifications: Appointment to Other Boards
2. There shall be five (5) members of the planning commission, who shall represent insofar as is possible different professions and occupations.  One member shall be a member of the Village Council to serve as member ex officio during his/her term.  Four members shall be appointed by the Village President.  These appointments shall be ratified and confirmed by the Village Council. 

Members of the Planning Commission may be appointed to other Village boards and commissions, e.g., the Village’s Downtown Development Authority board.

• Section 2 – Publication

This Ordinance shall be published once, in full, in The Marcellus News, a newspaper of general circulation within the boundaries of said Village and qualified under State law to publish legal notices, within 15 days after its adoption, and the same shall be recorded in the Ordinance Book of said Village and such recording authenticated by the signatures of the President and Village Clerk.

• Section 3 – Severability

Should any portion, sentence, paragraph, clause, phrase or word of this Ordinance be declared unconstitutional, illegal or of no force or effect by a court of competent jurisdiction, such decision or judgment shall not affect the validity of the remaining portions thereof which shall continue to remain in full force and effect.

• Section 9 – Effective Date

This ordinance shall become effective 20 days after publication, on February 17, 2025, at 12:01 a.m.
