Adopted January 28, 2025 – Ordinance No. 256
An ordinance to expedite the removal of snow from public streets, publicly owned parking areas and alleys within the Village of Marcellus during the winter months by regulating parking and by imposing civil penalties and fees for violation thereof and for the repeal of Village of Marcellus Ordinances No. 217 and No. 224.
THE VILLAGE OF MARCELLUS ORDAINS:
Section 1 – Purpose
The purpose of this ordinance is to expedite the removal of snow during winter months by imposing regulations for parking within the Village of Marcellus.
Section 2 – Definitions
Park or Parking shall mean the standing of any vehicle, other than temporarily for the purpose of and while engaging in the loading or unloading of merchandise or passengers or when stopped for making necessary repairs.
Street shall mean the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the public for vehicular travel. This Ordinance does not apply to StateHighways within the Village of Marcellus.
On-Street Parking shall refer to the parking of a vehicle on the public streets within the Village of Marcellus.
Publicly-Owned Parking Areas shall mean the parking lots owned by the Village of Marcellus, including, but not limited to, the parking lots east of 102 East Main Street and west of 128 East Main Street; the parking lots just south of the alley between the 100 block of East Main Street and the 100 block of East Dibble Street; and the parking lot located just east of 177 East Main Street and west of North Burney Street.
Alley or Service Alley shall mean the narrow passage running between or behind buildings or a continuous row of houses which permits access from the side streets to backyards or garages.
Regulated Winter Parking Times shall mean all dates between November 1 through December 31 and January 1 through March 15 of each year between the hours of 3:00 a.m. and 3:00 p.m.
Section 3 – On-Street Parking Regulations
During regulated winter parking times, parking shall be limited to the following:
- On Monday, Wednesday and Friday of each week, parking shall be prohibited on the north and east sides of any street.
- On Tuesday, Thursday, Saturday and Sunday of each week, parking shall be prohibited on the south and west sides of any street.
Section 4 – Alley Parking Regulations
Parking in any alley is prohibited at all times throughout the year.
Section 5 – Publicly-Owned Parking Area Regulations
A) Littering and Burdening Public Property
It is prohibited and is unlawful for the person(s) in control of any private property within the Village of Marcellus and such person(s)’ employee(s), agent(s) or contractor(s) to deposit snow and ice from said private property onto the streets, alleys or sidewalks of the Village.
B) Littering and Burdening Private Property
It is prohibited and is unlawful for any person(s) in control of any private property within the Village of Marcellus and such person(s)’ employee(s), agent(s) or contractor(s) to deposit snow and ice from said private property upon any other private property within the Village without first having obtained the express permission and consent of the person(s) in control of the latter private property upon which said snow and ice is being deposited/is proposed to be deposited.
C) Publicly Owned Off-Street Parking
Parking is prohibited in/on any publicly owned off-street parking area every day from November 1 through December 31 and January 1 through March 15 of each year between the hours of 3:00 a.m. and 7:00 a.m.
Section 6 – Penalties
Any person who violates any section(s) of this Ordinance shall be deemed to have committed a municipal civil infraction and shall be subject to the payment of a civil fine as set forth in Ordinance No. 248, Civil Infractions Ordinance; vehicles parked in violation thereof may be towed and/or impounded at the owner’s expense.
Section 7 – Registered Owner Responsibility
If a vehicle receives a parking ticket, the owner at the time of the violation shall be responsible for payment of the ticket.
Section 8 – Waiver or Dismissal of Parking Tickets
Village Staff are not permitted or authorized to waive or dismiss parking tickets issued under this Ordinance.
Section 9 – Severability
Should any portion, sentence, paragraph, clause, phrase or word of this Ordinance be declared unconstitutional, illegal or of no force or effect by a court of competent jurisdiction, such decision or judgment shall not affect the validity of the remaining portions thereof which shall continue to remain in full force and effect.
Section 10 – Repeal
Village of Marcellus Ordinance No. 217 Winter Parking and Ordinance adopted November 24, 2015, and Ordinance No. 224, Winter Parking and Snow and Ice Removal from Public and Private Property Ordinance, adopted January 24, 2017, are hereby repealed.
Section 11 – Effective Date
This Ordinance shall become effective on March 8, 2025, at 12:01 AM.
Section 12 – Publication
This Ordinance shall be published once, in summary form or in full, in The Marcellus News, a newspaper of general circulation within the boundaries of said Village and qualified under State law topublish legal notices, within 30 days of its adoption.
