An Ordinance Amending and Revising Section 5 of Ordinance No. 218, to Repeal and Replace Ordinance No. 240 (Compensation of the Marcellus Village President, Village President Pro Tempore and Marcellus Village Trustees) to Establish and Provide for Compensation for the Trustee Serving as a Marcellus Village President, President Pro Tempore and Village Trustees.

THE VILLAGE OF MARCELLUS ORDAINS:
Section 1 – A. Purpose
The purpose of this Ordinance is to amend and revise Section 5 (Compensation of the Marcellus Village President and Marcellus Village Trustees) of Ordinance No. 240, to repeal and replace Ordinance No. 240 and to establish and provide for compensation for the Trustee servicing as Marcellus Village President Pro Tempore.

Section 2 – Amendment and Revision of Section 5 (Compensation of the Marcellus Village President and Marcellus Village Trustees) of Ordinance No. 218 and Ordinance No. 240; and to establish and provide for compensation for the Trustee serving as Marcellus Village President Pro Tempore.

A. Said Section 5 of Ordinance No. 218 is hereby revised and amended to read as follows:

Section 5 – Compensation

Compensation of the Marcellus Village President, Marcellus Village President Pro Tempore and Marcellus Village Trustees (and as Members of the Marcellus Village Council).

A. Former Compensation of Members of the Marcellus Village Council prior to Ordinance No. 218.
1. The compensation levels previously established and authorized for the Village President and Trustees by action of the Marcellus Village Council are hereby ratified and confirmed.

B. Compensation of Members of the Marcellus Village Council Authorized by This Ordinance; Changes in compensation, as permitted and provided by MCL 64.21.

1. The Marcellus Village President shall be compensated/paid the sum of $230.00 per each regular meeting attended and the sum of $90.00 per each special meeting of the Marcellus Village Council and each local intergovernmental forum/meeting attended but [no additional compensation at present] for administrative, public relations and constituency services rendered as Marcellus Village President.

• The Trustee serving as the Marcellus Village President Pro Tempore shall be compensated/paid the sum of $130.00 per each regular meeting attended and the sum of $90.00 per each special meeting of the Marcellus Village Council and each local intergovernmental forum/meeting attended but [no additional compensation at present] for administrative, public relations and constituency services rendered as Marcellus Village President Pro Tempore.

• Each of the other Marcellus Village Trustees shall be compensated/paid the sum of $90.00 per each regular and special meetings of the Marcellus Village Council and each local intergovernmental forum/meeting attended but [no additional compensation at present] for Marcellus Village Council committee meetings attended and public relations and constituency services rendered as a Marcellus Village Trustee. 

• As required by MCL 64.21, any change in such compensation shall require adopting and approving such changes by ordinance. 

Section 3 – Severability.

            Should any portion, sentence, paragraph, clause, phrase or word of this Ordinance    be declared unconstitutional, illegal or of no force or effect by a court of competent       jurisdiction, such decision or judgment shall not affect the validity of the remaining      portions thereof which shall continue to remain in full force and effect.

Section 4 – Effective Date.

1. Effective Date of this Ordinance shall be 20 days after adoption, i.e., on April 14, 2025. 

Section 5 – Publication 

            This Ordinance shall be published once, in summary form or in full, in The Marcellus News, a newspaper of general circulation within the boundaries of said Village and   qualified under State law to publish legal notices, within 15 days of its adoption. The same shall be recorded in the Ordinance Book of said Village and such recording authenticated by the signatures of the Marcellus Village President and the Marcellus Village Clerk.
